At least in rhetoric, this is a big win for the government. Time will tell.

The #STF (Brazilian #SupremeCourt) ruled that states can buy vaccines without the approval of the #ANVISA ('Agência Nacional de Vigilância Sanitária,' or National Health Regulatory Agency), which is the Department of Health's branch responsible for giving the approval of safe use of any product or service that's related to health, produced in #Brazil or imported. Under this rule, the approval of a vaccine by the health agency of the country of origin will be enough.

Among the governors in favor of bypassing the gov't's agency, #SãoPaulo's Governor #JoãoDória has been the most vocal, prompting President #Bolsonaro to repeatedly say that no vaccination will be sold in Brazil without ANVISA's approval. The decision of the STF is another humiliation for Bolsonaro if he doesn't have any card under his sleeve.

It's important to note that not a single vaccine company from any country has ever asked ANVISA for authorization so far, which is suspicious.

And today the STF voted unanimously in favor of compulsory vaccination. One more humiliation for the president (again, if he doesn't have any card unde his sleeve) who publicly and repeatedly said that no Brazilian would be forced to take the vaccine.

Some judges said that nobody will be forced to take it if it means people going through any kind of embarrassment or humiliation, but there's a caveat. Private and public institutions and businesses will be allowed to demand that their employees, clients, and customers prove that they are vaccinated. For instance, an airline can demand passengers to show this proof in order to board the plane or buy a ticket, and a school can demand it in order to accept an enrollment.

The Brazilian #SupremeCourt judge (called 'minister' or 'minister-judge' in #Brazil) #LuísRobertoBarroso just released a book called 'Sem data venia: Um olhar sobre o Brasil e o mundo,' or 'No data venia: An overview about Brazil and the world,' and it contains a passage that prompted Senator #LasierMartins (#Podemos-RS) to resquest that the #Senate #Constitution and Justice Committee summons #Barroso to clarify said passage. It says:

“THE ARTICULATION TO TAKE DOWN THE POSSIBILITY FOR CRIMINAL RULINGS BE CARRIED OUT AT THE SECOND INSTANCE OF JUSTICE WAS THE STRONGEST OF THE REACTIONS, SEEKING TO CHANGE THE VOTE OF TWO JUDGES OF THE SUPREME COURT THAT, UNTIL THEN, WERE EMPHATICALLY FAVORABLE TO THE RULING.”

He is basically saying that he knows that two judges changed their votes due to political pressure. Now he has to explain how he knows it was political pressure, and the two judges will have to say who pressured them. This is serious stuff. Another question is, if he knew about something so serious, why did he not say anything, but just mentioned it in a book as if it were nothing?

Another action of malice from some of the mainstream news outlets was saying that a senator caught hiding money between his buttocks in #Roraima was the vice-leader of the gov't in the #Senate.

Yes, he was the vice-leader, but he was not a direct nomination. He was chosen to be the vice-leader by a party that happens to support the president, but #Bolsonaro had no role in choosing him.

AND THE #SUPREMECOURT'S (#STF'S) POLEMIC PUNISHMENT One of the judge-ministers punished the senator with a 90-day suspension and this decision outraged many congresspeople and senators, and was widely criticized. The reason is that the judge-minister didn't wait for the regular proceedings to take place, which included the #Senate itself to take some action.

The judge-minister's decision has been seen as a disrespect for the separation of powers and as a virtue-signaling act; an unconstitutional act.

One of the Brazilian #SupremeCourt's judge-ministers let a high profile drug dealer leave prison and now police doesn't know where he is. Among the crimes #AndrédoRap had committed was the delivery of tons of cocaine to #Europe.

After the House of Representatives dismantled an anticorruption package and voted for it, criminals no longer need to stay in jail before their case is judged by the fourth and last court; the highest, the Supreme Court. Until then, a criminal can remain free, or go back into the streets.

But, in order for the criminal to remain free or go back into the streets, a letter of justification of incarceration has to be sent for the next higher court judge to sign, and this letter has the validity of three months, otherwise the criminal can't leave or remain free. This signature can take time, but if the criminal gets the money to pay for an attorney to rush their case into a superior court, problem solved.

In this drug dealer's case, the justification letter allegedly was not sent, and his attorney wrote a habeas corpus, to which the judge-minister accepted, even though he knew he was dealing with such a high profile criminal.

During an interview to #CNNBrasil on the radio, the judge-minister, #MarcoAurélio, abruptly ended the interview when the interviewer asked him to comment on the fact that the law-firm that wrote the habeas corpus belongs to one of his ex-employees in the Supreme Court.

The Electoral #SupremeCourt (#TSE) announced on #Twitter three partnerships to help them fight #fakenews, #misinformation, and #disinformation with the goal of preventing those from influencing the elections.

The partnership were made with #Google, #TikTok, and Twitter. Fact-checkers are also helping the TSE. Google and Twitter have long been accused in #Brazil, in the #UnitedStates, and in other countries of manipulating search results, and doing shadowbanning and censoring. TikTok has been in hot waters with the US for fear of spying on Americans, and fact-checkers are criticized also here and everywhere for not being accountable to anyone else (who fact-checks the fact-checkers).

TSE is urging people to denounce users who share news with others, and says that one shouldn't forward a post if:

  1. You don't totally trust the sender;
  2. You don't find the source of the information;
  3. You can't distinguish an opinion from a reporting;
  4. You are not sure the news is true.

WHAT TSE IS (DELIBERATLY?) MISSING

  1. An average person doesn't have all the tools and/or time to go after knowing if a piece of news is a 100% true. And if they find the source, how do they know the source is true? If a TSE fack-checker says it's true, who can prove the fact-checker is true?

  2. Many stories that eventually come out to be true were one day only unproven suspicions, and as more and more people talked about it, people with more capacity (tools and time) to investigate it, like journalists, dug deeper, finding superficial evidence, then they denounced it, and then it was investigated by the police, finally finding hard evidence. So, by discouraging people from being open about their suspicion, a lot of stories may never come to light.

It doesn't stop there. TSE will receive online voting project ideas from 29 technology companies. Three Brazilian cities are going to carry out a simulation test already in the 2020 elections. The trust in the electronic voting machine is already low, even though they work offline, and TSE is considering carrying out votes through the internet?

Why is TSE doing everything contrary to common sense?

#Bolsonaro just had his first chance to appoint a #SupremeCourt judge, but the choice wasn't so outright pleasing to his electoral base as was #AmyConeyBarrett in the #UnitedStates. They were waiting for a clearly conservative name, but the one he chose, #KassioMarques, was involved in some controversial rulings and has also had some connection to leftwing people, groups, and politicians. Many people on the right side reacted aggressively and showed strong disappointment.

The president goes live every Thursday night and on the last one he explained that many of the bad things rightwing people are accusing the judge of were not well explained and that the media was talking advantage of that to provoke discord. He also said that he knows Kassio and has had some interactions with him, and that contributed to his choice.

Three of the rulings that angered rightwingers: 👉 #CesareBattisti, an Italian that was hiding in #Brazil accused of killing 4 people back in #Italy, was denied deportation by the #STF (Supreme Court) back to Italy to pay jail time, and Kassio had a role in this, but Bolsonaro also explained that there was something to it, and that the truth is that Kassio didn't vote against his deportation; 👉 Another ruling that angered rightwingers was that he voted against a City Hall ruling against something related to the #LGBT agenda. In fact he did, but he did so so that there wouldn't be a precedent for cities to rule over anything independently of the gov't, because just as that city was voting against something from the LGBT agenda, other cities could do the opposite and the gov't wouldn't be able to do anything; 👉 He was against the #LavaJato ( #CarWash ) operation; 👉 He was against going to jail after judgement in the equivalent to the circuit court in the #UnitedStates, allowing the defendant to remain free until their case is judged by the Supreme Court.

One final factor that contributed to Bolsonaro choosing Kassio is the fact that he's a name that has more chances to be approved by the Senate. This one, actually, is the biggest factor. The president said that a name that is largely approved by his base wouldn't stand a chance given how dominated by the left the Senate still is.

There's one curious thing. Many on the left are not happy with Kassio's nomination, which could be proof that Bolsonaro's choice might have been a proper move at this moment.
